1. Description of services
   
   
   • Bronze level members shall have access to the forums and blog on the website.
   
   
   • Silver level members shall have access to the forums, blog, monthly teleseminar, first webinar of the month, and 10 minutes of coaching per month.  Silver level members shall also have access to recordings of the monthly teleseminar and first webinar of the month for the rest of that calendar month.
   
   
   • Gold level members shall have access to the forums, blog, monthly teleseminar, all 3 webinars of the month, and 30 minutes of coaching per month.  Gold level members shall also have access to recordings of the monthly teleseminar and all webinars for the rest of that calendar month as well as all existing teleseminars and webinars that have taken place in the previous five months.  In addition, gold level members who commit to a 6 month or 1 year subscription will also be placed in a mastermind group, with 2 sessions per month.
   
   
2. Access to the website
   
   Creative Wedding Video Education strives to provide the website to its Subscribers on a continuous basis.  Creative Wedding Video Education will take all commercially reasonable efforts to provide uninterrupted access to the website to its Subscribers.  However, from time to time, Subscribers may be unable access the website due to conditions beyond Creative Wedding Video Education?s control, including but not limited to acts of God, power outages, and the acts of computer hackers or those acting outside the law.  Access may be unavailable due to, but not limited to, software issues, server downtime, Internet downtime, regular maintenance of the system, and other related reasons. 
   
   Users are solely responsible for ensuring that they have sufficient and compatible hardware, software, telecommunications equipment and Internet service necessary for use of the website.


3. Sign Up Requirements; Privacy Notice
   
   Creative Wedding Video Education recognizes the importance of protecting the privacy of its Subscribers.  Information concerning the Subscriber will not be sold, leased, rented or provided in any manner to any person or organization, except to make authorized charges against the Subscriber?s PayPal account.
   
   Information gathered during sign up regarding geographical location will be used in selecting members for Mastermind Groups that are not located in the same geographical area. 
   
   Information regarding topics of interest will be used to help select topics for each month?s educational sessions.


4. Prohibited Conduct
   
   User expressly agrees to refrain from doing, either personally or through an agent, any of the following Prohibited Conduct:
   
   
   • Capture, download, save, upload, print or otherwise retain information and content available on the Site other than what is expressly allowed by these Terms.
   
   
   • Permit or provide others access to creativeweddingvideoeducation.com using your user name and password, or the name and password of another authorized User.
   
   
   • Copy, modify, redistribute, republish, create derivative works from, assign, license, transfer or adapt any of the information or other content available on the website.
   
   
   • Transfer the website content to another person.
   
   
   • Violate or attempt to violate creativeweddingvideoeducation.com’s security measures.
   
   
   • Engage in any other conduct which violates the Copyright Act or other laws of the United States.
   
   
   • Post obscene, harassing, defamatory, violent, pornographic, abusive, threatening, objectionable or illegal material on the website; post a communication that advocates or encourages criminal conduct or conduct that may give rise to civil liability.
   
   
   • Advertise or otherwise solicit funds, goods or services on the website, without explicit permission of Creative Wedding Video Education.
   
   
5. Limited Warranties
   
   Although Creative Wedding Video Education has attempted to provide accurate information on the site, it makes no guarantee or warranty, express or implied, as to the reliability, accuracy, timeliness or completeness of that information and assumes no responsibility for any errors or omissions therein.
   
   User accesses the website at his/her own risk.  The website is provided on an "as is, as available" basis without warranty of any kind.  Any advice given by Creative Wedding Video Education or other Subscribers is not warranted to be legally sound.


6. Third party hyperlinks
   
   You acknowledge that Creative Wedding Video Education does not pre-screen third party materials.  creativeweddingvideoeducation.com may contain links and references to third party websites and materials and provides these links solely for the convenience of Subscribers.  Creative Wedding Video Education does not endorse or otherwise recommend any of these third party websites, or the products, services, or information there offered.


7. Copyrights, trademarks and other proprietary rights
   
   Creative Wedding Video Education shall retain all rights in the intellectual property in and on the Site, including but not limited to inventions, ideas, the source code, the PHP code, the "look and feel? of the website, its color combinations, layout, and all other graphical elements, and the copyrights in and to its original content.  Nothing that the Subscriber reads or sees on the website may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use without the prior written consent of Creative Wedding Video Education.


8. Indemnification
   
   User agrees to indemnify and otherwise hold harmless Creative Wedding Video Education and its officers, directors, agents, employees, shareholders, successors and assigns from and against any cause of action or claim, including court costs, expenses and attorney fees, related to or arising from User?s Prohibited Conduct or other improper or illegal use of the site, or breach of these Terms.  Liability is limited to the amount of fees collected from the Subscriber for use of the website.


9. Security; Authorized Use
   
   Users are required to enter a user name and password to access the website.  Subscriber is responsible for maintaining the secrecy of Subscriber?s user name and password.  You may not use the account, user name, or password of someone else at any time.  You may be held liable for any losses incurred by Creative Wedding Video Education due to someone else?s use of your account, user name, or password.


10. Billing Conditions (Silver level and above)
    

You are agreeing to be charged for a subscription service. You will be billed now, and will be automatically billed again periodically from today's signup date until you cancel the subscription. You can cancel the subscription by contacting us at (402) 894-0017.  If you cancel within a billing cycle, you will not be billed for the following period.

Creative Wedding Video Education grants each subscriber a limited, non-sub-licensable and non-transferable license to access the content and information available on the website, subject to payment of the applicable subscription fees and adherence to these Terms.  Subscriber may not allow any persons, other than full-time W-2 employees of their company, to use subscriber's login name and password to gain access to the website.

2. Definitions
   
   
   • "Creative Wedding Video Education? refers to Creative Wedding Video Education, Inc., a Nebraska corporation.
   
   
   • "Subscriber? refers to any person who purchases a subscription to Creative Wedding Video Education.
   
   
   • "Website" or"Site? refers to the website maintained by Creative Wedding Video Education, creativeweddingvideoeducation.com.
     "You? or"Your? refers to the subscriber.
   
   
   • "Terms" or "Agreement" refers to these Terms and Conditions of Use and any subsequent modifications.
     "Gold Content? refers to content available on the website to gold level subscribers.
     "Silver Content? refers to content available on the website to silver level subscribers.
     "Bronze Content? refers to content available on the website to bronze level subscribers.
   
   
3. Modification of Terms
   
   Creative Wedding Video Education reserves the right to modify these Terms at any time.  Notice will be given through email to subscribers.


4. Fees; Renewal
   
   Per Month:
   Subscription renews monthly until cancelled by Subscriber.
   Automatically renews on the same date of each corresponding month or on final date of month if no corresponding date (January 31, 2010 subscription renews on February 28, 2010).
   Fees charged on renewal date
   
   6 month membership:
   Subscription renews every 6 months until cancelled by Subscriber
   Automatically renews on the same date of 7th month or on final date of month if no corresponding date (January 31, 2010 subscription renews on July 31, 2010)
   Fees charged on renewal date
   
   Annual membership:
   Subscription renews yearly until cancelled by Subscriber
   Automatically renews on the same date of each corresponding year or on the final date of month if no corresponding date
   Fees charged on renewal date


5. Discounts, rebates, or other special offers only valid for initial term; subscriptions renew at the then-current full subscription rates.


6. Refund Policy
   
   Subscription fees are non-refundable; except that Subscriber may cancel renewed subscription in writing up to three (3) calendar days after renewal date and receive a full refund of the new (renewal) subscription fees.
   
   The Subscription may be terminated by the Subscriber at any time by notice to Creative Wedding Video Education.  Upon termination the Subscriber shall forfeit any right to a refund of his or her subscription payment or any portion thereof for the current subscription month.  Creative Wedding Video Education may terminate this Agreement upon 30 days notice to Subscriber and if, when the notice is given, more than one month remains of the user?s subscription, a proportional amount will be refunded to the Subscriber.


11. Miscellaneous
    
    If any portion of these Terms is determined to be unenforceable for any reason, such portion will be deemed severed and the remaining terms and conditions shall continue in full force and effect.  Failure of Creative Wedding Video Education to exercise any remedy or enforce any portion of this agreement at any time shall not operate as a waiver of any remedy or of the right to enforce any portion of the agreement at any time thereafter.  Creative Wedding Video Education operates this website from the United States, and makes no representation that the website complies with any foreign or international laws.  You agree to comply with all applicable local laws, including any international laws, in using this Site.
    
    These terms and any claim or action related to or arising from these terms or content on the site shall be governed by Nebraska law, without regard to any provision that would make the laws of another jurisdiction applicable.
